This Release of Liability, Assumption of Risk, and Indemnification Agreement (“Agreement”) is entered into by the undersigned adult participant, or the parent or legal guardian of the minor participant (collectively, “Participant”), as a condition of participation in any youth fishing event organized or sponsored by Day at the Lake, a Washington nonprofit (“DATL”).
This Agreement is intended to be a legally binding release of liability and risk assumption to the fullest extent allowed under the laws of the State of Washington.
1. Assumption of Risk
Participant understands and expressly acknowledges that participation in fishing, boating, and outdoor recreation involves inherent and significant risks, including but not limited to: drowning, falls, slips, entanglement with fishing gear, collisions with boats or docks, sun exposure, hypothermia, animal or insect encounters, or unexpected weather conditions.
Participant voluntarily and knowingly assumes all such risks, whether known or unknown, foreseeable or unforeseeable, arising directly or indirectly from participation in the event.
2. Release and Waiver of Liability
In consideration of being permitted to participate in the event, Participant, on behalf of themselves, their minor child, and their respective heirs, legal representatives, successors, and assigns, does hereby release, waive, discharge, and covenant not to sue the following entities and individuals (collectively, the “Released Parties”):
- Day at the Lake, a Washington nonprofit;
- Jeffrey Young, individually and in his capacity as organizer and event leader;
- Sukit Baits, including its owners, officers, employees, agents, and affiliates;
- Volunteer boat captains participating in the event;
- Any and all event sponsors, volunteers, staff, and representatives, whether compensated or uncompensated;
from any and all claims, demands, damages, causes of action, costs, losses, or liabilities, whether in law or equity, arising out of or relating to bodily injury, illness, death, or property damage sustained during or as a result of participation in the event — whether caused by negligence, omission, or otherwise.
3. Medical Authorization
Participant authorizes DATL, its volunteers, and any licensed medical personnel on-site to administer or obtain emergency medical care for the minor participant if deemed necessary. Participant agrees to be solely financially responsible for any medical services rendered.
4. Rules, Regulations, and Equipment Compliance
Participant acknowledges and agrees to follow all DATL event rules, including but not limited to:
- Proper and continuous use of U.S. Coast Guard–approved life jackets while on the dock or in a boat;
- Compliance with all Washington Department of Fish & Wildlife (WDFW) regulations, including fishing license requirements for minors aged 15 and older;
- Adherence to the reasonable instructions and oversight of assigned captains, organizers, and volunteers.
5. Media Consent and Release
Participant grants DATL, Jeffrey Young, Sukit Baits, and affiliated media personnel the irrevocable right and permission to photograph, film, and otherwise record the minor during the event and to use such images or recordings for promotional, educational, or nonprofit purposes in print or online, without compensation or prior approval.
6. Indemnification
Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all third-party claims, demands, liabilities, damages, legal fees, or costs arising from the Participant’s or minor’s conduct, violations of rules, or failure to follow event guidelines.
7. Severability and Governing Law
This Agreement shall be governed and interpreted in accordance with the laws of the State of Washington, without regard to conflict-of-law principles. If any provision of this Agreement is found unenforceable, the remainder shall remain valid and enforceable to the maximum extent permitted by law.
8. Acknowledgment and Consent
By signing below, the undersigned certifies that they have read, understood, and voluntarily accepted all terms in this Agreement and that they are the lawful parent or legal guardian of the minor participant.
They understand that this document contains a release of liability and a waiver of certain legal rights, and they knowingly and voluntarily agree to be bound by it.
Signature
This Agreement is signed electronically in the Day at the Lake registration form. The parent or legal guardian's checkbox agreement and typed full name serve as their signature. The names of each minor participant and the date signed are recorded with the registration.
